If you do not pay off your debts, your creditors can go to the court and get a wage garnishment. Some people say this is having their wages “garnished”, but the true term is a garnishee or garnishment.
The creditor will take you to court, sue you and acquire a Garnishment Order from the court. Exceptions include a Credit Union that you’ve given an assignment of wage to, or Canada Customs and Revenue Agency.
Even if you promise to pay the debt at this point, the creditor will, most likely, not agree to stop the wage garnishment. After all, they’ve gone through a lot of effort already.
Creditors garnish people they don’t believe will pay, or those who have not paid in the past.
It is up to the court to decide how much will be garnished from your wages.
If you are currently being threatened with a garnishment or if you are looking for a way to stop a wage garnishment that has already started, please contact our trustee right away. The longer you wait to take care of the situation, the more money you will lose from your paycheques.
